Apollonia Pushes Back Against Prince’s Estate In Los Angeles Federal Court Over Who Owns Her Name

LOS ANGELES, CA - I’ve read enough celebrity-IP fights to know when a dispute is really about leverage, and this one is exactly that. Patricia “Apollonia” Kotero says the Prince estate—through Paisley Park Enterprises—has been trying to claw back the stage name she has used for more than 40 years. Her lawsuit filed Tuesday, August 19, in Los Angeles seeks a declaratory judgment that she, not the estate, owns the APOLLONIA trademarks and can keep using them in entertainment and related ventures. She warns that if the estate succeeds at the Trademark Trial and Appeal Board (TTAB), an infringement suit against her could be next. 

Here’s the legal posture: The estate filed an “intent-to-use” federal trademark application for APOLLONIA on June 20, 2025, covering clothing and entertainment services. Around the same time, it pressed cancellation actions at the TTAB targeting Kotero’s existing registrations, arguing she isn’t the rightful owner and that the name doesn’t function as a trademark. Kotero’s complaint counters with classic equitable defenses—waiver, acquiescence, laches—saying Prince himself encouraged her professional use of the name and that the estate waited decades to object. The federal suit asks a judge to sort out priority, ownership, and the parties’ respective rights while TTAB proceedings continue. TTABVUE

On the facts, Kotero’s narrative is straightforward: she’s been “Apollonia” since Purple Rain made the name famous in 1984, and she’s used it consistently for performances, branding, and a podcast. That long, public, and source-identifying use is the backbone of her claim to senior common-law rights and the registrations that flowed from it. In her words, “There is only one Apollonia.”

The estate, for its part, has publicly labeled her lawsuit “frivolous” and points to early-1980s agreements and its stewardship of Prince-related IP as reasons it—not Kotero—controls the name. Those competing storylines preview a records-heavy fight over who used what, when, and how the public understood the name over time. 

From a trademark-law lens, two things jump out to me. First, TTAB cancellations and district-court declaratory actions often run in parallel; the TTAB decides registerability, while a federal judge can decide real-world ownership and infringement. Second, equitable defenses matter in celebrity-name disputes. If a rights holder sleeps on objections while the performer builds a brand, doctrines like acquiescence and laches can blunt late-stage enforcement—especially where fans have long associated the mark with the performer as a source. That’s exactly the frame Kotero is asking the court to adopt. 

Procedurally, the case sits in the U.S. District Court for the Central District of California as Kotero v. Paisley Park Enterprises LLC et al., No. 2:25-cv-07769. Expect early motions aimed at staying or coordinating with the TTAB proceedings, along with a fight over the evidentiary weight of historical contracts and prior registration records. The estate has not yet filed a detailed response on the merits in the federal action. PacerMonitor

As a legal analyst, I’ll be watching three levers: whether the court credits decades of marketplace reality over archival deal papers; whether the estate’s June 2025 application signals a pivot toward merchandising rights that intensifies the conflict; and whether a judge chooses to pause for the TTAB or push ahead to a clean, binding ownership ruling. For artists, the takeaway is simple—stage names are brands, and brands favor the party who uses them publicly, consistently, and as a source identifier.

Prince's estate, now split equally between music publisher Primary Wave and the artist's siblings, has been notably aggressive in protecting his intellectual property since his accidental fentanyl overdose death at 57. But this case presents a unique wrinkle: they're essentially arguing against someone Prince personally collaborated with and supported.

The legal precedents here favor Kotero, but trademark disputes involving deceased celebrities often involve complex licensing and assignment questions that can muddy the waters. Her attorneys are smart to seek declaratory judgment rather than waiting for the estate to sue first—it puts them in the driver's seat procedurally.

This isn't just about one performer's stage name. It's about whether estates can retroactively claim rights to identities their deceased clients explicitly encouraged others to develop. That's a question with implications far beyond Purple Rain.
