WASHINGTON, DC – On September 25, 2025, a federal grand jury in the Eastern District of Virginia indicted former FBI Director James B. Comey Jr. on two counts: false statements and obstruction. The indictment, returned after years of scrutiny surrounding Comey’s conduct during and after his FBI tenure, strikes at the heart of one of the most politically divisive eras in modern American law enforcement.
At issue is whether Comey misled Congress during sworn testimony before the Senate Judiciary Committee on September 30, 2020. According to the indictment, Comey “willfully and knowingly” made materially false statements when asked about his authorization of anonymous sources tied to an FBI investigation.
Specifically, prosecutors allege Comey denied ever authorizing FBI personnel to act as anonymous sources for news outlets, when in fact he had empowered Daniel Richman—his confidant, attorney, and later revealed to be an unpaid FBI affiliate—to leak information tied to “Person 1.”
