A Georgia federal court filing revealed that Mercedes-Benz USA LLC and staffing giant Randstad North America Inc. have reached a tentative settlement with a worker who accused them of violating the Fair Labor Standards Act (FLSA) by denying overtime pay.

In a joint notice submitted Thursday, Ciarrah Harrington and the two companies informed the court that they are finalizing formal settlement documents and expect to file an approval motion within the next 30 days. The parties also asked the court to stay the ongoing litigation while they complete the settlement process.

The Overtime Battle

Harrington filed the lawsuit in October 2024, alleging that both Mercedes-Benz and Randstad had willfully failed to pay her overtime wages, despite her routinely working more than 40 hours per week. The suit accused the companies of flouting federal wage laws and exploiting staffing arrangements to sidestep labor obligations.

Her complaint asserted that she was “billable labor” for both companies, performing duties essential to Mercedes-Benz’s operations, but was deprived of the legally required time-and-a-half pay.

Corporate Pushback and Legal Maneuvering

Both companies denied wrongdoing. In its February 2025 response, Mercedes-Benz argued that it was not Harrington’s direct employer, distancing itself from responsibility under the FLSA. Randstad, meanwhile, criticized the allegations as “vague,” contending that the claims lacked sufficient detail to establish liability.

Despite those denials, the companies opted to negotiate a resolution, a move that spares them a potentially drawn-out and high-profile wage dispute. The forthcoming approval bid will ask the court to bless the settlement terms — the details of which have not yet been made public.

Broader Implications for Labor Practices

The case, now leading to what’s being called the Mercedes-Benz staffing company OT settlement, underscores the growing scrutiny surrounding automakers and temp agencies that rely heavily on contracted labor. Labor advocates say such arrangements often blur the lines of accountability when it comes to fair pay and compliance with wage laws.

If approved, the settlement could mark a significant step in addressing joint employer liability — a legal gray area increasingly tested in U.S. courts.
