In a historic finale to one of the world’s most expensive legal sagas, the Dutch Supreme Court has rejected Russia’s final appeal to overturn $50 billion in arbitral awards owed to former shareholders of Yukos Oil Co., sealing the Kremlin’s fate in a case that has haunted it for two decades.

The ruling, issued Friday, closes the door on all legal remedies available to Moscow and confirms that the awards—now totaling over $65 billion with interest—are “final, irreversible, and enforceable” against Russia’s state assets across the globe, according to GML Ltd., the parent company representing former Yukos shareholders Hulley Enterprises Ltd., Veteran Petroleum Ltd., and Yukos Universal Ltd.

“No More Appeals — Justice Has Spoken”

In its published decision, the high court declared, “The Supreme Court dismisses the appeal,” ordering the Russian Federation to pay approximately €18,610 ($19,800) in legal costs and interest if payment is delayed. The court emphasized that this ruling “definitively ends” all proceedings by Russia to set aside the arbitration awards.

“This is it,” a GML spokesperson said Friday. “Set-aside is now done. We won.”

The monumental ruling stems from the 2014 arbitral tribunal in The Hague, which found that Russia illegally expropriated Yukos, once the country’s largest oil producer. The dismantling of the company—engineered under the guise of fraudulent tax claims—was widely viewed as politically motivated, following a fallout between Yukos founder Mikhail Khodorkovsky and President Vladimir Putin.

U.S. Courts Still Weigh Enforcement

While the Dutch decision ends Russia’s appeals in Europe, the fight continues in U.S. courts. On August 5, the D.C. Circuit Court of Appeals sent the case back to a lower court to reconsider whether the arbitration agreement between Russia and the Yukos shareholders is valid under the Foreign Sovereign Immunities Act (FSIA).

The appeals court faulted U.S. District Judge Beryl A. Howell for deferring to the arbitral tribunal’s judgment rather than independently evaluating Russia’s claim of sovereign immunity, writing:

“Whether an arbitration agreement exists is a jurisdictional fact… that must be independently evaluated by the district court.”

Russia argues that it never agreed to arbitration, noting that although it signed the Energy Charter Treaty (ECT)—which includes the arbitration clause—it never ratified it. Moscow insists that the treaty’s provisions conflict with Russian law.

A Two-Decade Battle for Justice

The Yukos dispute has spanned more than 20 years, crossing courts and continents. Following the expropriation, former shareholders launched a relentless global campaign to collect what they were owed. The Dutch Supreme Court’s ruling marks their most significant victory yet, though the challenge of enforcing the judgment remains.

GML CEO Tim Osborne hailed the decision as both a legal and moral triumph:

“This is not just a historic victory for Yukos shareholders—it reaffirms that no nation, not even a rogue state like Russia, stands above the law,” Osborne said. “Real justice, however, means enforcement. We will now target Russian assets worldwide until every penny of the $65 billion is paid.”

Tracing Russian Assets — and a Vodka Twist

In an unusual move to collect on the awards, the ex-Yukos shareholders last year auctioned off Benelux trademark rights for 18 Russian vodka brands, including Stolichnaya and Moskovskaya, netting €1.6 million ($1.7 million). The sale marked the first successful enforcement action against Russian state-linked property.

With the Dutch court’s decision now final, the Yukos shareholders’ global enforcement campaign is poised to accelerate—potentially targeting Russian assets frozen under international sanctions.

For Russia, the loss in The Hague is more than financial—it’s a symbolic defeat, a ruling that echoes across courtrooms and capitals, declaring once and for all that even the mightiest of states cannot rewrite the rules of justice.
