A federal grand jury has returned a two-count indictment against James Comey, 65, charging the former FBI Director with threatening the life of President Donald J. Trump via an Instagram post depicting ‘86 47’— and this time, there is a warrant for his arrest. The public may be about to witness a former chief of America’s top law enforcement agency in handcuffs.

The Instagram Post That Started It All

On May 15, 2025, James Comey — the man who once sat atop the most powerful law enforcement agency in the world — posted an image to his public Instagram account that would set off a federal criminal investigation. The image contained the numbers "86 47," a phrase that federal prosecutors and law enforcement officials widely recognize as coded language for killing the 47th President of the United States, Donald J. Trump.

It was not a private message. It was not an accidental share. Comey posted it publicly, to an audience of hundreds of thousands of followers, at a time when, as Acting Attorney General Todd Blanche noted,

“this country has witnessed violent incitement followed by deadly actions against President Trump and other elected officials.”

Federal investigators moved swiftly. The FBI opened an investigation, and on April 28, 2026, a federal grand jury in the Eastern District of North Carolina formally returned an indictment — charging Comey with two serious federal felonies.

The Two Federal Charges: A Legal Analysis

The indictment is a lean, targeted document — two counts, two statutes, one unavoidable legal conclusion if the evidence is as presented. Here is what each charge means and why it matters:

Count 1: Threatening the President (18 U.S.C. §871(a))

This is the heavier charge, and the one with more historical weight. Under Section 871 of Title 18, it is a federal felony to "knowingly and willfully" make any threat to "take the life of, kidnap, or inflict bodily harm upon" the President of the United States.

The government’s legal theory here will center on what courts call the "reasonable recipient" standard,which asks: Would a reasonable person familiar with the circumstances interpret the communication as a serious expression of intent to harm? Prosecutors argue the answer, in the context of an Instagram post by a public political figure using the numeric slang for “kill,” is unambiguously yes.

Critically, the statute does not require that Comey intended to personally carry out the threat — only that the threat was made knowingly and willfully. Courts have consistently held that public figures who broadcast threatening messages to large audiences face the same legal exposure as private individuals who make direct threats.
