Millions of Drivers May Have Fed An Insurance AI System Without Knowing It

What Drivers Need to Know

  • More than 15 million motorists could fall within a proposed nationwide class accusing CCC Intelligent Solutions of using information from collision-repair estimates for AI products without consumer consent.
  • The disputed records allegedly include names, addresses, phone numbers, VINs, license plates, claim numbers, mileage and photographs of damaged vehicles.
  • The case could test a much bigger question for the insurance industry — does permission to process a claim also mean permission to use the underlying information to build commercial AI?

CALIFORNIA - Three California motorists have accused one of the automobile insurance industry’s most deeply embedded technology companies of turning information collected after car accidents into fuel for artificial intelligence products without telling the people whose information was involved.

The proposed class action, Burries et al. v. CCC Intelligent Solutions Inc. et al., No. 2:26-cv-11794, was filed October 8 in the U.S. District Court for the Central District of California. Plaintiffs LaTrenda Burries, Gloribel Garcia and Katleen Saturné are suing CCC Intelligent Solutions Inc. and its publicly traded parent, CCC Intelligent Solutions Holdings Inc.

The allegations reach far beyond an ordinary dispute over a privacy policy.

According to the complaint, personal information placed into repair estimates generated through CCC ONE was retained and combined with data flowing through CCC’s network to develop AI products and analytics licensed to other businesses. The information allegedly includes names, home addresses, telephone numbers, insurance claim numbers, VINs, license plates, vehicle mileage and photographs taken after collisions.

The proposed nationwide class covers more than 15 million people identified on CCC ONE repair estimates created during the four years preceding the lawsuit, according to the plaintiffs. No class has been certified, and those allegations have not been proven.

But CCC’s scale makes the case particularly important.

In its own 2026 SEC filing, CCC said its network had processed more than $2 trillion in historical data, creating proprietary data assets drawn from insurance claims, vehicle repairs, automotive parts and other vehicle information. CCC says its AI-powered technology is already used by more than 125 U.S. insurers and 15,000 U.S. collision repairers. The company’s 2025 annual report says it has developed more than 400 AI models.

Those disclosures do not prove the plaintiffs’ allegations. They do, however, show why the lawsuit matters.

A driver walking into a body shop after an accident may reasonably understand that an insurer, appraiser and repair facility need personal and vehicle information to inspect the damage, calculate repair costs and process the claim.

That is different from knowingly volunteering information for development of commercial AI.

The complaint attacks that distinction directly. It alleges that contracts between CCC and insurers or repair facilities authorize certain data uses, but the motorists themselves are not parties to those agreements. According to the lawsuit, CCC’s insurer contract even contemplates using customer data to train AI services under certain circumstances.

CCC’s publicly available privacy policy says the company collects and uses information through its services and describes privacy rights available to consumers. The plaintiffs contend, however, that versions of the policy dating back to April 2020 did not disclose AI or model training as a use of this information.

The plaintiffs assert claims including intrusion upon seclusion, invasion of privacy under the California Constitution, unjust enrichment and violations of California’s Unfair Competition Law. They are seeking damages and restitution as well as injunctive relief that could require deletion of personal information and restrictions on using consumer information for AI training without consent.

CCC told Repairer Driven News that it “doesn’t comment on pending litigation.” The company had not filed a substantive response when the case was first reported.

Nothing has yet been decided. There has been no ruling that CCC violated anyone’s privacy, and no class has been certified.

Still, the lawsuit puts a question before the insurance and AI industries that is unlikely to disappear: when consumers hand over personal information because their car has been wrecked, where does processing the insurance claim end — and commercial AI development begin?
