Connecticut Judge Reduces Malpractice Award from $1.4M to $165K

In a striking decision, a Connecticut Superior Court judge has significantly reduced a malpractice award from $1.4 million to just $165,000. The case centered around an attorney’s oversight in a loan security, which led to a substantial financial dispute.

Connecticut Judge Whittles $1.4M Malpractice Award To $165K: Background of the Case

Safe IRA Partners LLC and the Mile Standish Trust initially demanded either $1.4 million or a staggering $3.7 million from attorney David E. Rosenberg and his previous affiliation, the Marinosci Law Group PC. This demand was based on an attorney’s failure to adequately secure a loan backed by property. However, Judge Robin L. Wilson slashed the award to $206,000 after recognizing that Safe IRA had already settled with other parties involved for $1.2 million.

Decision Details

Judge Wilson’s reduction of the award to just over $206,000 was initially a response to the substantial amount Safe IRA had recovered through settlements. The judge then further reduced this amount by 20%, citing Safe IRA’s partial responsibility for the mishap, which ultimately left the final award at $164,611 against Rosenberg and Marinosci Law.
