CVS $37.8M Settlement Ends Decade of Alleged Insulin Pen Overbilling

In a settlement that echoes like a warning shot across the pharmacy industry, CVS Pharmacy Inc. agreed Tuesday to pay $37.76 million to resolve federal allegations that it spent a decade overdispensing and overbilling government healthcare programs for insulin pens. Prosecutors say the violations, stretching from 2010 to 2020, inflated claims and broke trust in systems meant to safeguard taxpayer dollars.
A Decade of Premature Refills and Inflated Claims
According to the U.S. Department of Justice, CVS allegedly refilled insulin pen prescriptions too early, dispensed quantities beyond clinical need, and underreported the number of days of supply provided to patients enrolled in Medicare, Medicaid, Tricare, and the Federal Employees Health Benefits Program.
The government asserts that these actions led to a slew of false claims, marking substantial violations of the False Claims Act. Like clock hands spinning too fast to follow, CVS was accused of pushing refills prematurely in pursuit of quicker billing cycles.
“Pharmacies must follow appropriate refill schedules and accurately report what they dispense,” said U.S. Attorney Jay Clayton for the Southern District of New York. “CVS pharmacies frequently failed to do so.”
Whistleblowers Spark DOJ Intervention
The DOJ stepped in after reviewing 10 whistleblower lawsuits alleging that CVS staff were directed to submit claims using the maximum allowable days of supply for reimbursement—often a number lower than the actual supply dispensed to patients.
Clayton described CVS’s alleged practices as “a decade-long pattern” of prematurely refilling insulin prescriptions and billing government programs for excess quantities.
Management Knowledge and Audit Red Flags
Federal prosecutors say CVS management knew about the discrepancies. Pharmacy benefit managers (PBMs), acting as watchdog intermediaries, reportedly flagged dispensing violations in audits and issued chargebacks. But despite repeated warnings, CVS allegedly failed to implement corrective measures.
CVS Defends Its Practices Amid Complexity
A spokesperson for CVS told Law360 that insulin pen billing is “incredibly complex,” pointing to FDA labeling changes, limited packaging options, dosing variability and differing insurance requirements.
“While we do everything we can to ensure patients get the medications they need, insulin pen billing has long been a challenge for pharmacies,” the spokesperson said.
Settlement Breakdown and Federal Message
Under the settlement, CVS will pay approximately $24.5 million to the federal government, with the remaining funds distributed among participating states.
“This settlement reflects our commitment to holding pharmacies accountable, enforcing cost controls, and protecting taxpayers,” Clayton said, underscoring the DOJ’s determination to tighten oversight in the pharmaceutical sector.
