Food Biz Seeks Exit From Trademark Suit Over Discontinued Designs

Own Your Hunger Inc., a rising food company specializing in nut-based products, has filed a motion in California federal court seeking dismissal of a trademark infringement lawsuit brought by The Wonderful Co. LLC and Cal Pure Produce Inc., distributors of Wonderful Pistachios.

The motion, filed Wednesday, argues that the claims made by Wonderful Co. are based on discontinued packaging and obsolete trademarks that are no longer in use. Own Your Hunger emphasized that its current branding — finalized in January 2025 — does not feature the previously contested trademarks “Wonderspread” or “Wondersquare,” nor does it include the term “Wonderful.”

“Plaintiffs focus on outdated packaging while admitting our current design is entirely different,” the company stated in its motion. “Their amended complaint includes images of obsolete designs while acknowledging that our redesigned packaging has been in place since before the lawsuit was filed.”

Own Your Hunger contends that the legal basis for the lawsuit is now moot, as it has proactively rebranded its products. The company’s updated packaging refers only in small print to a product described as “the wonderspread that tastes so good, you’ll forget it’s nearly half the calories,” without any trademark use of “Wonderful.”

The company also stated that the U.S. Patent and Trademark Office’s prior denial of its applications for “Wonderspread” and “Wondersquare” was irrelevant to the current case, given the products’ new presentation.

In response, a spokesperson for The Wonderful Co. maintained their position, stating, “Own Your Hunger is improperly using packaging that infringes on our trademark. Their attempt to dismiss the case lacks merit, and we will vigorously defend our rights.”
