The Fifth Circuit Court of Appeals has blocked new electioneering rules in Palo Pinto County, Texas, finding that the regulations likely violate the First Amendment. "The Regulations ... restrict a substantial amount of speech beyond the 100-foot zone," the panel wrote, referring to Texas' existing restriction on political signs within a 100-foot buffer zone of polling places. The judges criticized the county for not providing clear guidelines on what constitutes prohibited "political" activity, leaving too much room for arbitrary enforcement.

The panel leaned on the U.S. Supreme Court's 2018 decision in Minnesota Voters Alliance v. Mansky, which struck down a Minnesota law banning "political" apparel at polling places due to its lack of clarity. The Fifth Circuit found that Palo Pinto County's regulations suffered from a similar lack of specificity.

The regulations stemmed from incidents during Texas' March primary elections, when conservative activists gathered at a major polling location in Palo Pinto County. The U.S. District Court initially denied their request for a preliminary injunction, reasoning that the county property was not a "public forum" under state law and thus not subject to strict scrutiny.

The Fifth Circuit disagreed, holding that the vague terms used in the regulations—particularly "political" and "electioneering"—were likely unconstitutional. The panel vacated the district court's ruling and granted the preliminary injunction, allowing the case to proceed with the plaintiffs likely to succeed.
