Union-Busting Tactics: Amazon Calls Police, and Fires Employees before Unionization Vote

Amazon, the e-commerce giant, has come under fire for its alleged union-busting tactics leading up to a unionization vote in the previous year.

Perhaps because of alleged anti-union tactics, workers at the Albany-area facility voted against joining the Amazon Labor Union (ALU).

US labor board prosecutors have lodged a formal complaint, claiming that Amazon's actions during this period violated federal law. This complaint underscores Amazon's controversial stance on unionization and its potential impact on the workforce.

“These allegations are completely without merit, and we look forward to showing that through the legal process,” said Eileen Hards, an Amazon spokesperson. “Dozens of charges filed at ALB1 have already been dismissed by the NLRB. And we look forward to having these allegations dismissed as well.”

Amazon's Union-Busting Tactics 

The complaint, submitted by a regional director of the National Labor Relations Board (NLRB), underscores Amazon's alleged repeated violations of federal law over several months. These violations are said to have taken place at an Amazon warehouse located outside Albany, New York.

The complaint alleges that Amazon not only prohibited discussions about the union during work hours but also conducted "mandatory or effectively mandatory" anti-union meetings.

It highlights several actions taken by Amazon that are believed to have undermined workers' rights. And may have stifled the unionization process.

 Among these accusations are instances of calling the police on employees, stifling discussions about organizing efforts, and terminating an outspoken activist. 

The complaint contends that Amazon's behavior was aimed at coercing its employees, so they were unable to exercise federally guaranteed rights.

According to the complaint, Amazon went as far as implementing a policy preventing employees from being on the company's premises before or after their shifts. This policy was allegedly used to target and discourage union activists. 

In one incident last August, Amazon reportedly terminated an employee for supporting the union and participating in collective action. The complaint suggests that this action was taken to dissuade other employees from engaging in similar activities.

“Amazon was so outrageous in their attacks on the union that it was impossible to successfully organize at the Albany-area facility,” the union’s attorney, Seth Goldstein, said Monday.

This isn't the first time Amazon has faced legal action related to its treatment of employees engaging in workplace activism.

In a separate case, a federal judge ruled against Amazon, ordering the company to cease retaliatory actions against employees involved in such activism. These instances highlight the growing scrutiny that Amazon's labor practices have come under in recent times.

Amazon's resistance, including appeals in federal court, demonstrates that it is willing to fight legal battles in order to keep the union at bay.

Remedies sought

 The remedies sought by the regional director, he said, would “help restore the opportunity to be able to organize in the facility.”

In response to the allegations, the complaint demands a series of corrective actions from Amazon.

 The company is urged to reinstate the activist who was terminated. And to give them back pay and a formal apology. 

It is also suggested that Amazon should facilitate a meeting between employees and the warehouse's general manager, during which a comprehensive notice about workers' rights would be read aloud. 

If any more anti-union "captive audience" meetings occur, the complaint calls for equal time to be allocated for the union to engage with employees.

What now?

Formal complaints issued by NLRB regional directors can have far-reaching implications for companies. These complaints are considered by agency judges, and their decisions can be appealed further, potentially leading to extended legal battles.

While the agency lacks the authority to impose punitive damages or hold executives personally accountable, the outcomes can still influence labor practices and corporate behavior.

The Amazon Labor Union (ALU), founded by both current and former Amazon workers, achieved a significant victory with a successful unionization vote at a New York warehouse. However, expanding its influence on other facilities and compelling Amazon to engage in contract negotiations has proven challenging.
