The U.S. Supreme Court is set to hear arguments this week on a pivotal case concerning a law that mandates the sale of TikTok by its China-based parent company, ByteDance. If there is no sale the law calls for a complete TikTok ban in the United States.

The outcome of this case will have significant implications for First Amendment rights, national security, and the future of one of the world’s most popular social media platforms.

Background of the TikTok Ban Law

In April 2024, President Joe Biden signed into law legislation that requires ByteDance to sell TikTok to a U.S.-based company. 

The law, upheld by a federal court in Washington, D.C., in December, is set to take effect on January 19, 2025. Despite TikTok’s efforts to block the ban, the Supreme Court declined their request for an emergency injunction, opting instead to hear oral arguments on the matter.

Key Arguments in the Case

TikTok and ByteDance contend that the ban infringes upon Americans' First Amendment rights. In their Supreme Court filing, the companies argued:

"If Americans, duly informed of the alleged risks of 'covert' content manipulation, choose to continue viewing content on TikTok with their eyes wide open, the First Amendment entrusts them with making that choice, free from the government's censorship."

The federal government has repeatedly claimed that ByteDance’s ownership of TikTok poses national security risks. And there is a potential for data manipulation and surveillance by the Chinese government.

 ByteDance, however, has consistently denied these claims and reiterated that it has no intention of selling TikTok.

Political Context and Contradictions

The TikTok ban has ignited political controversy, especially given President Biden’s previous use of the platform during his re-election campaign. Biden’s continued reliance on TikTok this summer stands in stark contrast to his signing of the ban into law in April. 

However, Biden’s withdrawal from the 2024 presidential race has shifted the spotlight to Donald Trump, who will be inaugurated for his second term just one day after the ban’s implementation.

Trump’s stance on TikTok has fluctuated over time. In 2020, he attempted to ban the app unless ByteDance sold it, but his efforts were blocked by federal courts.

 During his 2024 campaign, Trump launched his own TikTok account and assured followers he would “save TikTok in America” if elected. Despite these promises, Trump recently questioned the necessity of banning TikTok, asking, “Why would I want to get rid of TikTok?”

Trump’s Legal Actions

On December 27, Trump filed a legal brief requesting the Supreme Court to delay its decision until after his inauguration on January 20.

 The filing argues that the incoming administration should have the opportunity to address the political and constitutional questions surrounding the ban. The Department of Justice, however, has urged the justices to reject Trump’s request, citing its lack of focus on the First Amendment issues central to TikTok’s case.

Implications of the Ban

If the Supreme Court upholds the ban, TikTok’s availability in the U.S. will be drastically impacted:

• Downloading the App: After January 19, users will no longer be able to download TikTok from app stores. Apple and Google have been instructed to remove the app from their platforms once the ban takes effect.
• Existing Users: Current U.S.-based TikTok users, estimated at 170 million, will not be immediately prohibited from using the app. However, without updates or technical support, the app’s functionality will gradually decline, making it increasingly “unworkable.”
• Historical Precedents: India’s ban on TikTok in 2020, which affected 200 million users, led to a migration toward alternatives like YouTube Shorts and Instagram Reels. A similar shift could occur in the U.S. if TikTok is banned.

Options for ByteDance and the U.S. Government

The only way to prevent the ban is for ByteDance to sell TikTok or demonstrate genuine efforts to divest. While American companies such as Oracle, Walmart, and Microsoft have previously expressed interest in acquiring TikTok, ByteDance has consistently refused to sell the platform.

Should the ban proceed, Trump’s administration could explore several options:

1. Pausing the Ban: The law allows a 90-day pause if ByteDance proves it is negotiating a sale. Trump could invoke this provision, but without concrete evidence of a sale, his decision could face legal challenges.
2. Non-Enforcement: Trump could direct his Justice Department not to enforce the ban. However, this approach might discourage companies and users from engaging with TikTok, as it would still technically violate the law.

What’s Next for TikTok?

The Supreme Court’s ruling will determine whether TikTok continues to operate in the U.S. or faces a phased removal. Regardless of the decision, the case underscores the complex interplay between technology, free speech, and national security in the digital age.
