Death Or Life? Texas Jury Weighs Fate Of Tanner Horner In Penalty Phase Of Athena Strand Murder As Elon Musk Demands Execution

DECATUR, Texas — A North Texas jury on Wednesday continued weighing whether Tanner Lynn Horner — the former FedEx contractor who confessed to abducting and strangling 7-year-old Athena Strand in 2022 — should live out his days behind bars or be put to death.

The penalty phase of one of the most wrenching child murder cases in modern Texas history resumed at the Wise County Courthouse, where testimony has veered from heartbreaking statements by Athena's parents to graphic details of the little girl's final moments. Horner, 35, pleaded guilty on April 7 to capital murder and aggravated kidnapping, removing all doubt about his culpability and transforming the proceeding into a purely sentencing fight.

A Delivery That Ended In Murder

Athena Strand was an exuberant blonde kindergartener with a lifelong love of princesses, butterflies and her stuffed animals. She disappeared from her family's rural home in Paradise, Texas, on November 30, 2022, shortly after Horner pulled into the driveway with a FedEx package — a Barbie doll intended, prosecutors said, as an early Christmas gift from her stepmother.

Investigators later alleged that Horner struck Athena with his delivery van, panicked, and drove off with the injured child in the cab. Fearing, he told police, that she would tell her parents, he strangled her with his bare hands in a wooded area before dumping her small body along a dirt road. Athena was found two days later.

Her disappearance triggered one of the most intense Amber Alert searches in Texas history, mobilizing hundreds of law enforcement officers and FBI agents. Horner was arrested within 48 hours after investigators traced the delivery van's route.

The Sentencing Phase Turns Into A Portrait Of Grief

With guilt no longer in dispute, prosecutors with the Wise County District Attorney's Office have spent the past week methodically building a case that Horner is a continuing threat to society and deserves the death penalty. Jailhouse recordings, crime scene photographs and chilling recollections from investigators have been presented alongside heartbreaking testimony from Athena's family.

On Monday, Athena's mother, Maitlyn Gandy, took the stand and told jurors she had come "to be her voice." Through tears, she described the birthday parties that will never happen, the sleepovers she will never host, and the first day of kindergarten that became her daughter's last.

"Athena had a whole life ahead of her," Gandy testified. "He took it from her. He took it from us. He took it from everyone who ever would have known her."

Jessica Strand, Athena's stepmother, also delivered searing testimony about the morning the little girl vanished. Her stepfather Jason Strand spoke of a home that has never stopped being haunted.

A Defense Built On Autism, Lead Exposure And A Troubled Past

Horner's court-appointed lawyers have asked jurors to spare his life, arguing that mental illness, a recent autism diagnosis, documented childhood exposure to high levels of lead, and a deeply dysfunctional upbringing combined to produce a man incapable of the kind of rational choice that the death penalty presumes.

The defense is expected to present its own witnesses this week, including mental health experts and relatives. Their theory, in essence, is that a life sentence without the possibility of parole is both sufficient punishment and a more humane answer to a case in which the defendant has accepted responsibility.

Prosecutors have rejected that framing forcefully, telling jurors that Horner's own words — recorded in interviews with investigators — show calculation, not confusion. "He chose to abduct her. He chose to strangle her. He chose to dump her like trash," District Attorney Chris Box told the jury. "This is not a case about a man who did not know what he was doing. This is a case about a man who did exactly what he meant to do."

Elon Musk Weighs In As National Spotlight Returns

The trial has drawn an enormous national audience, fueled in part by gavel-to-gavel Court TV coverage and by the testimony of Athena's parents. Over the weekend, Elon Musk posted a terse message on X demanding that Horner "be executed immediately" — a statement that drew millions of views, sparked fierce debate, and was quickly shared across true-crime and political social media circles.

The intensity of public feeling has worried courtroom observers who note that Horner's jury has been sequestered and carefully shielded from outside commentary. Judge Brock Smith has repeatedly admonished jurors to rely solely on evidence presented in court.

What Comes Next

The defense is expected to wrap its case this week, after which both sides will deliver closing arguments in the penalty phase. Jurors will then be asked a series of Texas-specific "special issues" — in essence, whether Horner poses a continuing threat to society and whether any mitigating circumstances justify a sentence less than death. A unanimous "yes" on the threat question and a unanimous "no" on mitigation would result in a death sentence; any holdout juror would lead to life without parole.

Whatever the verdict, it will not bring Athena Strand back. But it will, at last, close a legal chapter that has stretched across four Thanksgivings and four Christmases without her. For a community still raw from her loss — and for parents across America who saw their own children in that tiny blonde girl on the Amber Alert — the verdict, when it comes, will matter.

Athena would have turned 11 this year.
