Black Delta Fired worker suit end

A legal challenge accusing Delta Air Lines of race-based pay discrimination and retaliation came to an abrupt halt after a former Black employee voluntarily dismissed his case, according to filings in Georgia federal court.

Case Withdrawn With Prejudice

Former Delta recruiter Alex Barr filed a notice of voluntary dismissal with prejudice on Sunday, formally ending his lawsuit and barring it from being refiled. The suit alleged violations of Title VII of the Civil Rights Act and 42 U.S.C. Section 1981, claiming Delta paid him less than non-Black colleagues and later eliminated his role in retaliation for raising concerns.

Allegations of Unequal Pay and Scrutiny

Barr alleged that he began working full time for Delta Air Lines Inc. in August 2022 after serving as a contractor. In his complaint, filed in November 2024, he claimed that he and another Black employee were assigned more complex duties than non-Black peers while being subjected to closer disciplinary oversight.

He said white coworkers who committed similar errors were not disciplined, while he was placed under coaching and scrutiny.

Pay Disparity Raises Red Flags

According to the complaint, Barr learned in November 2022 that his compensation lagged significantly behind that of colleagues performing similar work. When he raised the issue with supervisors, he said they pledged to explore reclassifying his position—but never followed through, despite repeated follow-ups.

Barr said a supervisor informed him in June 2023 that his pay would remain unchanged, even though his workload matched that of higher-paid employees. He then escalated the issue to human resources, the suit alleged.

Retaliation Allegations Follow

Soon after contacting HR, Barr claimed his supervisors retaliated by issuing him a warning for an allegedly disrespectful email tone. He said the pressure intensified when he took his concerns to a senior employee relations manager.

Barr alleged he was excluded from meetings, denied professional development opportunities and saw his time-off requests rejected. In September 2023, Delta terminated his employment, citing a role elimination. Barr contended that no other employees were laid off, casting doubt on the explanation.

Delta Pushes Back

Delta denied Barr’s allegations in a February answer, disputing that he complained to HR about discrimination or retaliation. The airline also argued that portions of his claims were untimely and said compensation and termination decisions were based on legitimate, nondiscriminatory business factors.

In a March filing, Delta further asserted that Barr failed to identify similarly situated employees who were paid more than him, arguing he compared himself to workers in different, higher-paying roles. The airline also said Barr’s retaliation claim failed because he did not allege complaints of bias before his termination.
