As the last whispers of the pandemic fade away, the very courts that upheld justice through it all have revealed an impending change: come September 22nd, federal judges may give the public the chance to tune into select civil and bankruptcy court proceedings through live audio. However, the scope isn’t as broad as it was during those days when courthouse doors remained shut.

Courts to Offer Audio Access : Tracing the Path of Change

The Judicial Conference of the United States, the nation’s court-policing entity, ushered in this policy alteration during its biennial assembly. It signifies a shift from the federal judiciary’s pandemic-centric stance on public access to court sessions. While this new provision gets the green light on September 22, marking the expiration of the COVID-19 audio access policy, it carries certain stipulations.

  • Audio accessibility is restricted to non-trial sessions where witness testimonials are absent.
  • Criminal proceedings remain untouched by this change.
  • The facility for attorneys and litigants to make virtual court appearances will persist.

The tale of remote public access to federal court hearings took a momentary detour during the pandemic, providing an avenue for judges to offer audio access to civil and bankruptcy matters. A decision to extend this pathway was made in September 2022. Yet, as this extension breathes its last on September 22, it’s making way for a fresh policy molded by the Committee on Court Administration and Case Management.
