The case remains far from resolved, with significant implications for both Abrego Garcia’s fate and broader immigration enforcement practices. Justice Department attorney Jonathan Guynn indicated that if Abrego Garcia were released from pretrial detention in Tennessee, the Department of Homeland Security intends to remove him from the U.S., though they haven’t decided whether to send him to a third country or challenge previous court orders barring his removal to El Salvador.
This uncertainty leaves open the possibility that Abrego Garcia could end up back in CECOT prison, depending on the government’s final decision.
Judge Xinis has ordered additional testimony from government officials with “firsthand knowledge” who can testify about the government’s plans for Abrego Garcia’s removal if he’s released from detention.
“It’s like trying to nail Jello to a wall trying to find out what is going to happen next week [if he is released from detention],” Judge Xinis said.
