Google Search Dominance: DOJ Proposes Drastic Remedies in Antitrust Case

According to a US Justice Department (DOJ) court filing Google may have to sever parts of its search business into independent entities. And also, be required to share users' search data with its competitors. This is a part of the proposed remedies to the company’s search dominance on the internet.

These remedies are part of the DOJ's effort to obstruct Google's search dominance and recreate the platform without its allegedly monopolistic practices.

Google Search Dominance Under Scrutiny

In response to a 2020 lawsuit, Judge Amit Mehta ruled in August that Google had unlawfully abused its monopoly power in the search industry.

 The DOJ is now considering both "behavioral and structural remedies" to prevent Google from leveraging its other products—such as Chrome, Play, and Android—to bolster its search dominance and related products.

This ruling is the result of an antitrust case filed by the DOJ and several U.S. states, accusing Google of "unlawfully maintaining monopolies" over search and search-related products, thereby stifling competition and maintaining its grip on the search industry.

DOJ Lawsuit and Its Implications

The 2020 lawsuit asserted that Google engaged in illegal practices to maintain its dominant position in the search market. 

One of the primary allegations was that Google paid billions of dollars annually to companies like Apple, Samsung, and Mozilla to secure its spot as the default search engine on their devices and browsers. This practice, the DOJ argued, gave Google an unfair advantage, preventing competitors from gaining the scale needed to compete.

Currently Google facilitates nearly 90% of web searches. 

Its default search engine agreements have greatly contributed to its continued command of the marketplace.  By paying off major players in the tech industry, Google not only benefits from increased revenue but also collects vast amounts of data that its rivals cannot access.

Judge Mehta’s ruling says this practice illegal, emphasizing that Google’s contracts with companies like Apple, Mozilla, and Samsung were part of a strategy to maintain its monopoly. Additionally, the DOJ is exploring limits on Google’s ability to enter into such contracts moving forward.

In a particularly revealing moment during the court proceedings, a Google executive testified that the company paid Apple a staggering $26 billion to keep its search engine as the default on iPhones.

DOJ and Google Debate the Remedies

The DOJ's proposed remedies include restrictions on Google’s use of search data to train its generative artificial intelligence (AI) models, as well as preventing it from making search engine contracts with other companies. 

Google, however, has pushed back against these proposals.

In a blog post, Google's VP of Regulatory Affairs, Lee-Anne Mulholland, called the DOJ’s ideas "radical and sweeping." She warned that the government’s plan would impact a wide range of industries and products, including smartphones, browsers, and AI technology.

Mulholland argued that forcing Google to share users' search queries and results with competitors would create significant privacy and security risks. Because the company currently protects this data with strict security measures. 

She also posted that splitting off products like Chrome and Android would weaken their security, complicate patch management, and raise costs for consumers.

According to Mulholland, these changes would “raise the cost of devices, undermine Android and Google Play’s competition with Apple’s iPhone and App Store.”  This would ultimately reduce revenue for companies like Mozilla and Android smartphone manufacturers, potentially leading to less innovation and higher device prices.

The Road Ahead for Google and the DOJ

The DOJ has until November 20 to submit a more refined set of remedies to the court. In response, Google has until December 20 to propose its own solutions to address the court’s concerns. 

The outcome of this antitrust case could reshape the digital landscape, particularly for Google’s search business, and set a precedent for regulating other tech giants.
