Hunter Biden Found Guilty of Three Felony Gun Charges

WILMINGTON, Del. — Hunter Biden, the son of President Joe Biden, was found guilty on Tuesday of three felony gun charges by a federal jury in Wilmington, Delaware. The charges carry a combined maximum sentence of 25 years in prison.
The jury deliberated for approximately three hours before delivering the historic guilty verdict, marking the first time a child of a sitting president has been convicted of felony charges. Sentencing is expected to take place in around 120 days.
Hunter Biden left the courthouse at 11:35 a.m. accompanied by First Lady Jill Biden and his wife, Melissa Cohen Biden.
Biden had pled not guilty to the charges related to his purchase of a Colt Cobra 38 SPL revolver from StarQuest Shooters and Survival Supply gun shop in Wilmington on October 12, 2018. During the federal background check, Biden checked "no" when asked if he was using or addicted to narcotics or controlled substances on his ATF Form 4473.
Hunter Biden was indicted by a federal grand jury in September 2023 after U.S. District Judge Maryellen Noreika rejected a plea deal negotiated with the U.S. Attorney's Office for the District of Delaware. Biden's subsequent motions to dismiss the charges were denied by Judge Noreika in April.
The jury, composed of six men and six women, was selected on June 3, with the trial commencing the following day and concluding on June 10.
Jill Biden attended all but one day of the trial. Hunter Biden's supporters in the gallery included his wife Melissa, sister Ashley Biden, benefactor Kevin Morris, and several family friends.
Biden's attorney, Abbe David Lowell of Winston & Strawn LLP, argued that Biden did not "knowingly" lie on the background check paperwork because he was sober at the time and not using drugs. However, prosecutors presented evidence from text messages, bank records, phone calls, and witness testimonies indicating ongoing drug use, making the firearm purchase illegal.
Prosecutors highlighted Biden's pattern of withdrawing $50,000 in cash per month from ATMs between September and November 2018 as indicative of drug use. Much of the evidence presented during the trial was retrieved from Biden's laptop, which was obtained by federal authorities after he left it at a repair shop in Wilmington in April 2019.
Witnesses for the prosecution included Hunter Biden's ex-wife Kathleen Buhle, ex-girlfriend Zoe Kestan, and sister-in-law and ex-girlfriend Hallie Biden. The defense called three witnesses: an employee and the owner of the gun shop, and Hunter Biden's daughter Naomi.
