IRS Deal to Share Immigrant Tax Data with ICE Triggers Lawsuit

IRS ICE Taxpayers Agreement

In a move that’s sending shockwaves through legal and immigrant advocacy circles, the Internal Revenue Service has entered into a contentious data-sharing pact with Immigration and Customs Enforcement (ICE), igniting a high-stakes courtroom battle over privacy, power, and the definition of criminality.

A Secret Agreement Comes to Light

Like a twist in a political thriller, a redacted memorandum of understanding surfaced late Monday in a D.C. federal court, revealing that the IRS has agreed to provide ICE with taxpayer records of noncitizens under criminal investigation—even when those investigations aren't tax-related.

The agreement, now under intense scrutiny, was disclosed as part of a lawsuit filed by four immigration advocacy groups—Centro de Trabajadores Unidos, Immigrant Solidarity DuPage, Somos Un Pueblo Unido, and Inclusion Action for the City—who argue the arrangement dangerously oversteps legal boundaries.

Cracks in Confidentiality

At the heart of the legal storm is Section 6103 of the Internal Revenue Code, a bulwark designed to protect taxpayer confidentiality. Yet, as IRS Chief Privacy Officer Kathleen Evey Walters pointed out, the code holds exceptions—particularly when information is requested for criminal investigations.

So far, no data has been requested or handed over, Walters noted, but the agreement has laid the groundwork for potential disclosures.

In a legal defense filed by the U.S. Department of Justice, the government argues that ICE's access is lawful:

"DHS can legally request return information relating to individuals under criminal investigation, and the IRS must provide it."

Critics Sound the Alarm

However, immigrant advocates and some lawmakers aren’t buying it. The lawsuit contends that the Trump-era policy falsely conflates civil immigration violations with criminal conduct—an insidious sleight of hand that could unlock taxpayer files with little justification.

“Obtaining access to return and return information by falsely characterizing civil immigration enforcement as criminal law enforcement would circumvent Section 6103’s carefully crafted protections,” the plaintiffs argue.

Senator Ron Wyden, D-Ore., the Senate Finance Committee’s ranking member, blasted the agreement, calling it an "illegal move" that could erode protections for all Americans:

“This abuse of the immigrant community is a moral atrocity, and you'd be a fool to think Trump won't go after others he dislikes, including American citizens.”

Trump’s Immigration Legacy Continues

The Department of Homeland Security (DHS) hailed the agreement as part of President Donald Trump’s crackdown on illegal immigration. A spokesperson stated that information sharing across federal agencies is critical to addressing public safety threats and rooting out undocumented individuals from voter rolls and public benefit programs.

"The government is finally doing what it should have all along: sharing information across the federal government to solve problems," the DHS said.

To its critics, however, the language is chilling—a rhetorical fog concealing a deeper erosion of rights and safeguards.

Who’s Fighting and Who’s Defending

Representing the plaintiffs are heavyweights in public interest litigation:

  • Nandan M. Joshi and Michael T. Kirkpatrick of Public Citizen Litigation Group

  • Kevin L. Herrera and Mark H. Birhanu of Raise the Floor Alliance

  • Alan B. Morrison of George Washington University Law School

The U.S. government is represented by Joseph A. Sergi and Andrew J. Weisberg of the Department of Justice. The DOJ, while defending the agreement vigorously in filings, has declined public comment.

What’s at Stake

Though no records have yet been exchanged, the lawsuit may set a precedent with wide-reaching implications. If the court upholds the IRS-ICE pact, it could embolden further inter-agency data exchanges and redefine the limits of taxpayer privacy—not just for immigrants, but for every American.

As the legal battle unfolds, one thing is clear: the IRS ICE Taxpayers Agreement has ignited a fierce debate that cuts to the core of privacy, due process, and the future of federal data power.
