Like a thunderstorm threatening ancestral lands, Maverick Gaming's attempt to dismantle the Native Americans gaming compact with Washington state has ruffled feathers. A coalition of 22 tribes, united in purpose, has implored the Ninth Circuit to dismiss Maverick's appeal. The reason? Maverick, they assert, can't sidestep the sovereign immunity of the tribes by directly suing state and federal representatives.

In an amicus brief, these tribes, echoing ancestral voices, expressed that Maverick was well aware of its strategic move - suing government bodies but bypassing the actual stakeholders: Washington's 29 federally-recognized tribes.

Unearthing the Roots of the Dispute

Maverick's intentions, crystallized in their July 2022 lawsuit, are audacious. Their goal is to annul the tribal gaming agreements, citing claims of racial discrimination and breach of the Indian Gaming Regulatory Act. The tribes, in retort, stress that such actions jeopardize their primary funding channel for vital community services.

These tribes painted a vivid, haunting portrait: "A successful challenge would not merely dent our finances but would unleash a financial tempest, wreaking havoc on our education, healthcare, and public safety budgets."

The Judicial Verdict and Maverick's Counter

The winds first began to stir when U.S. District Judge David G. Estudillo deemed that the Shoalwater Bay Tribe, an intervenor in Maverick's case, was pivotal to the litigation. Yet, due to the tribe's sovereign cloak, it couldn't be tied to the lawsuit. This led to the case's dismissal under the Federal Rules of Civil Procedure.

But Maverick wasn't ready to fold. They took their grievances to the Ninth Circuit, arguing Judge Estudillo's ruling was akin to a tree falling against the prevailing wind, contradictory to numerous precedents.

Strong Counter from the Tribes

The tribes, channeling centuries of resilience, countered in their briefs. Their message was clear: the Ninth Circuit's precedence unequivocally calls for Maverick's challenge to be dismissed. Further, the federal government, they stated, couldn't adequately defend the tribes' interests.

Why? "Federal Defendants are not walking in our moccasins," the amicus brief stated, underlining the differing interests between the two parties. The tribes elaborated that financial discrepancies and potential legal interpretations could alter the federal approach to the lawsuit.

Moreover, Maverick's second and third claims, the tribes emphasized, didn't involve the federal government at all. A victory for Maverick in those areas would leave the federal government with potentially no stance to challenge the outcome.

Representatives for the Shoalwater Bay Tribe, in a cinematic Monday announcement, voiced their appreciation for the unified stand of the tribes. The suit, they said, jeopardizes not just a singular gaming establishment but challenges the very livelihood of countless tribe members across all facilities.
