Their mission? To unearth any further instances of communication during depositions.

Their diligence bore fruit. A second deposition, this one of NuVasive’s Dustin Shields, showcased another set of covert text exchanges.

This time between Shields, Alysa Ward, and Shelly Ward, a senior case manager at NuVasive. Interestingly, the evidence hints that both sets of text messages originated from Alysa Ward’s phone.

The plaintiff’s motion highlighted the murky waters they were navigating, stating, “In the present case, the full extent of the deposition misconduct is not yet fully determinable.” This saga has added a layer of complexity to a case that began in October 2022 when Darrow alleged discrimination under the Americans with Disabilities Act.

What’s Next?

As the legal tempest rages on, Darrow alleges the company gave him the cold shoulder when he sought a role that would protect him from further radiation exposure, as recommended by his doctors. This lawsuit, which traces its origin to Darrow’s dismissal in December 2020, is set to culminate in a courtroom showdown this coming February.
