Robert Religa, the inventor of a patented source code involving “structured energy patterns, photonic collision and dynamic linguistic displays” used as a medical treatment, has filed an intellectual property (IP) lawsuit against Las Vegas-based wellness technology company Energy Enhancement System LLC.
Religa, along with Light Systems Inc., which holds an exclusive license to Religa’s “Synchronicity Engine” code, alleges that Energy Enhancement and its key figures, Sandra R. Michael and Michael Bertolacini, engaged in a deliberate campaign to misappropriate and profit from Religa’s copyrighted technology. The suit, filed in the U.S. District Court for the Eastern District of New York, claims that Energy Enhancement has unlawfully reaped over $100 million in revenues by exploiting Religa’s code.
According to the complaint, Religa developed the code in 1989 and secured its copyright in 2011. Plaintiffs assert that Energy Enhancement falsely claims ownership of the technology in marketing materials, despite knowing these claims are untrue. The company’s revenues reportedly surged from $21,000 to nearly $100 million between 2021 and 2024, expanding from 20 centers to more than 700 centers worldwide.
“This exponential growth reflects a reckless strategy to saturate markets with systems materially identical to Religa’s copyrighted code, creating consumer confusion and delaying Religa’s legal recourse,” the plaintiffs state.
The lawsuit also alleges that Sandra Michael initially convinced Religa to enter a licensing agreement in the early 1990s, during a period when he was in poor health, but subsequently breached the agreement by making unauthorized medical claims and ceasing royalty payments.
Religa and Light Systems have since entered a new exclusive license agreement and seek legal remedy for the ongoing misuse and misrepresentation of their technology. The defendants, meanwhile, have filed a counter-suit alleging defamation and trademark infringement.
