But when the American Bar Association (ABA) decided to carve out a section in its model rules of professional conduct forbidding attorneys from discriminatory or harassing behavior, it set off tremors in the foundations of the legal community.

On one side stood the champions of ABA Model Rule 8.4(g), hailing it as a beacon for marginalized voices in the legal world. On the opposing front, detractors waved the banner of free speech, seeing the rule as a potential silencer. And in this age-old game of push and pull, litigation wasn't far behind.

The Courtroom Saga of Zachary Greenberg

One attorney, Zachary Greenberg, fearful that his educational sessions on the constitutionality of hate speech bans might become targets, challenged Pennsylvania's iteration of the rule. He envisioned a world where every seminar held the menace of a career-jeopardizing complaint. For Greenberg, every speech became a tightrope walk over the chasm of disciplinary repercussions.

However, in a twist befitting a courtroom drama, the Third Circuit recently pulled the rug from under Greenberg's case. They posited that the looming specter of the rule's enforcement on him was merely a phantom, as he faced "no credible threat of enforcement."

Peering behind the curtains of public disciplinary records paints a revealing picture. The Third Circuit's assertion might not be as baseless as one would think. Few, if any, have faced the fiery wrath of this new rule in places where it's been put into play.

But where one sees a safety net, another perceives shackles. Adam Schulman, who donned the role of Greenberg's legal knight, pointed out the shadows lurking beneath. Even unprosecuted complaints, obscured from the public eye, carry their own burdens, haunting attorneys long after their filing.

When the curtains rose on 8.4(g), it was heralded as the legal world's clarion call against prejudice and discrimination. Echoes from law students, particularly from women and people of color, resonated with this sentiment. They aspired to a profession where ethics denounced discrimination.

Yet, the echoes of dissent were equally loud. Some, like law professor Eugene Volokh, envisioned a dystopian landscape where lawyers constantly self-censored. David Nammo, of the Christian Legal Society, expressed anxieties about it curtailing religious freedoms.

The Deterrence Debate: Silence or Safety?

Today, both camps find a rare convergence in thought. They acknowledge that the rule's scarce appearance in public disciplinary scenarios might be a testament to its preventative power.

To some, like Samp, it paints a bleak picture, suggesting lawyers are stifling their voices. For Lynk, it's a necessary evolution. Yet, amid these debates, there's a whisper that perhaps, just perhaps, misconduct persists unnoticed.

A study by nonprofit Women Lawyers on Guard revealed that an alarming 86% of sexual harassment cases go unreported. Their findings lay bare the timeless fears— of not being believed, facing retribution, or enduring escalated harassment.

Speaking up against a colleague or professional acquaintance is not as straightforward as lodging a complaint against an opponent.
