Thailand’s Supreme Court Clears Ex-Prime Minister Yingluck Shinawatra of Charges

Thailand's former Prime Minister Yingluck Shinawatra has been vindicated by a unanimous ruling from the Supreme Court.

This clears her legal battles and potentially paves the way for her return to the country after over 6 years in self-exile. 

The ruling, delivered on Monday, effectively quashes the last remaining case against her brought by the National Anti-Corruption Commission.

Yingluck Shinawatra cleared 

Yingluck Shinawatra, 56 had been embroiled in legal turmoil since 2022, facing allegations related to events that occurred during her tenure between 2013 and 2014. 

The charges centered on accusations that she granted publicity rights to two newspapers for an infrastructure roadshow without following a competitive bidding process. It was alleged she had misallocated public funds totaling 240 million baht ($6.7 million USD).

The Thai Supreme Court's verdict determined that Yingluck's actions did not constitute an abuse of power. 

The court emphasized that she lacked full knowledge of the selection process and asserted that approving the newspapers fell within the discretionary powers of the prime minister and the cabinet to allocate budgetary resources.

This latest ruling adds to Yingluck's acquittal in December in a separate case regarding political appointments. 

These legal victories signal a significant development for the former prime minister, who had faced severe legal consequences, including a five-year prison sentence in absentia over her government's rice-pledging scheme.

The Supreme Court held that there was a lack of evidence to pursue the charges.

Thaksin Shinawatra returns to Thailand

Yingluck Shinawatra fled Thailand in August 2017, joining her brother Thaksin Shinawatra, 74 in self-exile. 

Thaksin returned to Thailand in August 2022, coinciding with the election of the Pheu Thai Party's Srettha Thavisin,  as prime minister. Thavisin is viewed as an ally of the Shinawatra clan.

Yingluck remained in exile. The rescinding of the arrest warrants against her marks a significant turning point. And offers her the prospect of returning to Thailand.

Thaksin Shinawatra's October return after 15 years of exile brought renewed attention to the Shinawatra family's influence in Thai politics.

His eight-year sentence was commuted to one year. And he was detained in a hospital for six months before being granted clemency because of his age and ill health.

The Supreme Court rulings reinforced the now favorable dynamics to the family.

Srettha Thavisin leads country

The Supreme Court's decision not only clears Yingluck Shinawatra's name but also raises questions about the future trajectory of Thai politics. 

With the legal obstacles seemingly removed, speculation abounds regarding whether Yingluck will choose to reenter the political arena and what role she might play in shaping the country's future.

Paetongtarn Shinawatra is the leader of Thailand's ruling Pheu Thai Party and daughter of former Prime Minister Thaksin Shinawatra. She took on the role in October.

There is speculation that May will bring a cabinet reshuffle that might be difficult for Srettha. 

Paetongtarn said her party's coalition would stay together to support Prime Minister Srettha Thavisin, as its head.

On January 26th in an interview with news outlet Nikkei Asia Paetongtarn said "I think he's the right man at this hour for the country.  If the government can stay for a long time and be more stable, that would be the perfect scenario for us."

As Thailand navigates through these developments, the spotlight remains firmly on the Shinawatra family and their enduring influence on the nation's political landscape.
