[USA HERALD] - Federal agents arrested Don Lemon late Thursday on allegations that he violated federal law during a January protest inside a St. Paul church, according to statements from his legal counsel and federal authorities. The incident stems from Lemon’s presence inside Cities Church on January 18, where demonstrators disrupted an active religious service by chanting “ICE out.”

The church’s pastor is an Immigration and Customs Enforcement official, a fact prosecutors say places the incident squarely within federal jurisdiction. Authorities allege that Lemon entered the church alongside demonstrators, shared their purpose, and acted in coordination with them during the interruption of worship.

Although the underlying case was dismissed last week by a magistrate judge on procedural grounds, federal prosecutors subsequently sought Lemon’s arrest, citing renewed charging theories tied to civil rights and religious-freedom statutes.

Lemon has insisted he was present solely in a journalistic capacity. That claim, however, may now be the prosecution’s strongest piece of evidence.

The Law Lemon Is Facing and the Consequences if Convicted

Federal officials have pursued two primary criminal theories against Lemon and other participants:

  1. Conspiracy to Deprive Rights Under Color of Law
    Prosecutors allege that Lemon knowingly joined a coordinated effort to interfere with the congregation’s federally protected right to worship free from intimidation or disruption. If convicted, this offense can carry felony penalties, including potential prison time and fines.
  2. Interference With Religious Exercise in a House of Worship
    Federal law explicitly criminalizes intentional obstruction or intimidation that interferes with religious services. Participation does not require leading the protest—acting in concert is sufficient. Conviction can result in incarceration, probation, and supervised release, particularly when the interference is planned and deliberate.

Crucially, journalistic status provides no blanket immunity. Courts have repeatedly held that reporters are subject to the same criminal laws as the public when they actively participate in unlawful conduct rather than observe it.

Lemon’s own statements—where he explicitly links his presence inside the church to covering and engaging with the protest as it unfolded—may allow prosecutors to establish the required intent element.

Lemon’s Defense and the Government’s Position

Abbe Lowell, Lemon’s attorney, said his client was arrested in Los Angeles while covering the Grammy Awards and vowed to fight the charges.

Lowell stated: “Don has been a journalist for 30 years, and his constitutionally protected work in Minneapolis was no different than what he has always done.”

But federal officials counter that once Lemon entered the church with demonstrators and acted in unison with them during the service interruption, he ceased being a neutral observer. According to Justice Department officials, the First Amendment does not shield conduct that impedes others’ constitutional rights.

Justice Department leaders have emphasized that the prosecution is not about speech or viewpoint—but about conduct inside a protected religious setting.

Evidence, Records, and What Can Be Proven

Based on publicly available information, prosecutors are expected to rely on:

  • Video and audio recordings showing Lemon entering the church with demonstrators and remaining during the disruption.
  • Lemon’s own public statements and videos, in which he describes his actions and acknowledges active engagement with those involved.
  • Law-enforcement reports and charging documents outlining the coordination between demonstrators and Lemon during the incident.
  • Witness statements from church members, clergy, and law-enforcement personnel present during the service.

If introduced at trial, Lemon’s assertion that he was “doing journalism” while inside the church could be used to establish knowledge, intent, and participation—key elements of the charged offenses.

What’s Next Procedurally

Lemon is scheduled to appear in federal court in Los Angeles on Friday. His legal team is expected to file motions challenging jurisdiction, intent, and the applicability of federal civil-rights statutes.

Prosecutors, meanwhile, are likely to oppose dismissal and argue that Lemon’s conduct meets the statutory thresholds for criminal interference with religious freedom. If the case survives pretrial motions, it could proceed to discovery, where video evidence and communications will become central.

The case also carries broader implications for journalists, activists, and media figures who embed themselves within protests occurring in legally protected spaces.
