Carnival Truck Collision Trial : Allegations of Negligence

The lawsuit claims Butcher was negligent by following too closely, speeding, driving too fast for the conditions, engaging in distracting activities, and failing to maintain a proper lookout for other vehicles. It also alleges that Awesome Amusements is vicariously liable for Watson’s injuries due to their employment relationship with Butcher. Additionally, T.H.E. Insurance Co. is cited in the suit, with potential liability up to the limits of its coverage.

Legal Proceedings

The suit was initially filed in Muscogee County Superior Court in June and subsequently removed to the Middle District of Georgia. Awesome Amusements and Butcher have sought dismissal of the case, arguing improper service of the summons or complaint.
