The magic of mail-in ballots, this time coupled with a Democrat judge, has erased a 28,000 vote lead for Republican Claudia Tenney and given her Democrat opponent the win.

It happened in a New York Congressional election for the 22^nd district in which the  Tenney, had the giant lead on the incumbent Democrat Rep. Anthony Brindisi on Election night, The New York Post reported.

But now, after mail-in ballots were counted and a judge personally reviewed “spoiled” ballots, the Democrat has a 12 or 13 vote lead.

“In NY-22, the Democrat incumbent was trailing by almost 30K on election night,” Hot Air editor Jazz Shaw said on Twitter. “The mail-in ballots got him close. Then a Democrat judge from Syracuse ruled he would personally ‘review’ all of the spoiled ballots that had been rejected. Guess what happened next.”

“The judge miraculously ‘found’ enough ballots that he felt were okay and the incumbent now ‘leads’ by 13 votes,” he said.

“This process and the integrity of our election are critical to our republic. This judicial review has been fair, open, honest, and transparent, and I remain confident that voters’ voices will be heard,” Rep. Brindisi said. “In January, I will be sworn in and continue to work with both parties and stand up to anyone on behalf of all of New York’s 22nd district.”

After the mail-in votes were counted the Republican challenger still had a 100 – 200 vote lead until Supreme Court Justice Scott DelConte stepped in to stop the certification.

That is when the judge decided that he wanted to review the ballots that were in question himself, which ended with a 12 – 13 vote lead for the incumbent. But Tenny’s campaign is not done fighting.

“Brindisi’s premature declaration of victory is further evidence that his team has no interest in ensuring a fair process that preserves the integrity of the election and protects the rights of voters. We will fight to ensure that all and only legal counts are counted — not jump to faulty conclusions,” the campaign said.

Her patience paid off as the Herkimer County Board of Elections revised its final vote count, finding 35 more votes for the challenger and placing her in the lead by 12.

“Whiplash: now it's Claudia Tenney (R) back ahead of Rep. Anthony Brindisi (D) by 12 votes in #NY22 after Herkimer Co. revises its count,” journalist Dave Wasserman said. “Legal fight far from over.”

With the vote totals shifting back and forth and the margin razor thin it is unlikely that this vote will be decided anytime soon.
