The SVAMC strongly advocates for the safeguarding of confidentiality and stresses that disclosure of AI tools used is generally unnecessary. However, for ethical compliance, any AI-influenced information presented outside of established records must be disclosed to all parties involved.

Responsibilities of Arbitrators and Participants

Arbitrators are specifically instructed not to delegate any decision-making tasks to AI systems and to maintain a clear record of any AI-generated information used during proceedings. Similarly, users of AI must adhere to professional standards, thoroughly review all AI outputs, and avoid compromising the mediation’s integrity.

Leadership and Expertise at SVAMC

The task force responsible for drafting these pivotal guidelines includes notable experts such as Benjamin I. Malek, alongside other distinguished members like Orlando Federico Cabrera Colorado and Elizabeth Chan, among others. Their collective expertise underscores the SVAMC’s commitment to providing authoritative guidance on the use of AI in arbitration.
