In a stunning twist to the ongoing legal saga surrounding the $1.7 billion punitive damages verdict in the Ford Motor case, Georgia state's bid to intervene in the suit has been denied by Gwinnett County State Court Judge Joseph C. Iannazzone. This denial, a critical development in the legal battle, has sent shockwaves through the legal community.

$1.7B Ford Motor Case : State Law Obstacle

Judge Iannazzone's one-page order firmly asserted that Georgia's motion to intervene was unfounded, citing a specific state law that expressly bars the state from becoming a party of interest in the case. The law stated, "shall not be construed as making the state a party at interest."

James E. Butler Jr., the representative of the Hills, siblings Kim and Adam, who are at the heart of this high-stakes case, emphasized, "The state's motion is fundamentally flawed. The statute is crystal clear, as Judge Iannazzone held: the state may not be a 'party.'"

The Battle Unfolds

The state of Georgia had sought to intervene as a plaintiff, leveraging a state law that would allow it to recoup 75% of the punitive damages awarded. Their argument was rooted in the desire to safeguard the verdict while Ford undertakes its appeals process.

However, the Hills vehemently opposed this intervention. They contended that the state law only granted the state rights as a judgment creditor, which would only come into effect once the judgment had been paid. Importantly, it did not provide for the state to step in as a plaintiff.

Adding to the perplexity, the Hills' response brief argued that the state's intervention was belated, coming more than a year after the original verdict. During that time, Georgia had taken no concrete actions to protect the verdict.

Speculation arose that the state's main concern was the potential settlement between the siblings and Ford before the appeal concluded, which would leave the state with no entitlement to the awarded funds.

Ford and Georgia Stay Silent

Despite this seismic development, both Ford and the state of Georgia remained tight-lipped and unavailable for immediate comment on the situation.

$1.7B Ford Motor Case : A Tragic Legacy

The roots of this colossal legal battle trace back to a tragic incident in April 2014 when Kim and Adam Hill lost their parents, Melvin and Voncile Hill, in a rollover accident involving a 2002 Ford F-250 Super Duty. The Hills initially sued Cooper Tire & Rubber Co. and Pep Boys in December 2014, reaching settlements with these companies before trial in 2018. Subsequently, they pursued a lawsuit against Ford, accusing the automaker of knowingly selling trucks with weak, defectively designed roofs and failing to warn consumers about the associated risks.

The initial trial against Ford in 2018 resulted in a mistrial after a Ford expert violated a court order. Sanctions were imposed on the company, albeit not on its attorneys. The court held Ford responsible, stating that the weak roof had caused the couple's deaths and that Ford's failure to strengthen it was willful and reckless.

Last year, a retrial concluded with a shocking $1.7 billion in punitive damages and $24 million in compensatory damages awarded to the Hills. In a significant setback for Ford, Judge Iannazzone denied their request for a new damages trial and judgment notwithstanding the verdict. Ford has since initiated the appeal process.
