Tom Girardi Convicted Of Defrauding Clients

Once a titan of California’s legal world, Tom Girardi, now 85, has fallen hard from grace. A federal jury in California convicted the disbarred attorney on four counts of wire fraud, finding he had misappropriated $15 million in settlement funds from his own clients. Girardi, once celebrated for high-profile cases like the $333 million Pacific Gas & Electric settlement that inspired the movie Erin Brockovich, now faces the grim reality of his conviction after a three-week trial.

Jury Reaches Guilty Verdict in Ponzi Scheme Case

The jury’s decision came after just four hours of deliberation, underscoring the gravity of the evidence against Girardi. Prosecutor Ali Moghaddas painted a picture of Girardi as the orchestrator of a decade-long Ponzi scheme, deceiving clients with promises of payments while funneling their settlement money to fund his extravagant lifestyle. “Using client one’s money to pay client two, and client two’s money to pay client three,” Moghaddas explained, likening the case to a textbook Ponzi scheme.

Girardi’s luxurious life—marked by private jets, lavish parties, and a seemingly endless stream of indulgences—was all financed by money intended for his clients, Moghaddas argued. "You get them the money they deserve and you pay their money. Promptly pay them their money," Moghaddas told the jury, in stark contrast to the delays and deceit Girardi employed to keep the scheme afloat.

Tom Girardi Convicted of Defrauding Clients: Shifting Blame and Memory Issues

Girardi’s defense tried to deflect responsibility onto former Girardi Keese accounting executive Christopher Kamon, who faces a separate trial for embezzling millions from the firm. Girardi's federal public defender, Charles J. Snyder, also pointed to Girardi’s dementia as a potential factor, claiming his client’s cognitive decline prevented him from fully understanding the missing funds.

But Girardi’s own time on the stand didn’t help his case. Though he initially gave clear, detailed testimony about the firm’s glory days, he later claimed to have no memory of the trial or even his own lawyer’s name. His defense team had previously argued that Girardi was not competent to stand trial, but U.S. District Judge Josephine Staton ruled otherwise. She allowed Girardi’s lawyers to present evidence of his memory loss, but prosecutors contended Girardi was feigning cognitive decline to evade responsibility.

High-Profile Collapse and a Tangled Web of Lies

Girardi’s conviction marks a tragic end to a once-storied career. Known for securing massive settlements in class action and mass tort cases, his legal victories earned him wealth and influence in California’s legal and political circles. Girardi also gained fame in pop culture, thanks to his appearances on Bravo's The Real Housewives of Beverly Hills, where his then-wife Erika Jayne starred.

Evidence presented at the trial showed how Girardi siphoned $21 million of firm money to finance Jayne’s entertainment career, while also maintaining two private jets and other luxury items—all while clients begged for their rightful settlements. Among the victims were individuals who had suffered devastating tragedies: a man left in a coma after a gas explosion, a woman whose child was paralyzed in a car accident, and others who had endured life-altering injuries or losses.

Tom Girardi Convicted of Defrauding Clients : A Fall That Began With Lion Air

Girardi’s downfall began in December 2020 when an Illinois federal judge found him in civil contempt for allegedly withholding $2 million from the families of victims in the 2018 Lion Air plane crash. That ruling set off a cascade of accusations, eventually forcing Girardi and his firm into bankruptcy. Now, Girardi, Kamon, and his son-in-law David Lira face another trial related to fraud accusations in the Lion Air settlement.

The Trial’s End, but Not the Legal Battle

Tuesday’s verdict concluded the dramatic trial, where Girardi’s once-formidable defense crumbled under the weight of evidence. The jury was shown a trail of documents, emails, and spreadsheets that prosecutors said proved Girardi had been misusing client funds for years. Under California law, attorneys must keep client trust accounts from becoming overdrawn, but evidence revealed Girardi had used new client money to pay off older obligations, keeping his fraudulent enterprise alive.

Girardi now faces a future where his legal career is in ruins, his personal life in tatters, and his status as a convicted felon. Meanwhile, his victims, whose lives were profoundly impacted by the very cases Girardi claimed to champion, await justice.

The U.S. government was represented by Scott Paetty and Ali Moghaddas, while Girardi was defended by Charles J. Snyder, Samuel Cross, and J. Alejandro Barrientos of the Federal Public Defender’s Office for the Central District of California.
