Apple Unequal Pay Suit: Former Executive Claims Retaliation and Gender Pay Disparities

Apple Unequal Pay suit

In a high-profile lawsuit filed against Apple and one of its top executives, Mandana Mofidi claims she was forced to choose between an unjust performance improvement plan or resigning after reporting unequal pay and participating in an investigation into her supervisor’s conduct.

Unequal Pay and Retaliation Allegations

The legal battle, which unfolded in a California state court, accuses Apple of retaliating against Mofidi after she raised concerns about receiving less pay than her male colleagues. The suit also details her participation in an internal investigation into sexual harassment by Jay Blahnik, Apple's vice president of fitness technologies. Mofidi, who headed the audio division at Apple Fitness+, alleges that her efforts to address both gender pay disparities and workplace misconduct led to her being unfairly targeted.

Mofidi’s tenure with Apple began in May 2021. Throughout her time at the company, she said she received recognition for her excellent work. However, the dynamic shifted when her direct supervisor took medical leave in August 2022, following allegations of sexual harassment by Blahnik. At that point, Mofidi began reporting directly to Blahnik, a move she would later say set the stage for her mistreatment.

Raising Concerns About Pay Inequity

In her performance review, Mofidi said she confronted Blahnik about discrepancies in her pay compared to male colleagues. According to the lawsuit, Blahnik dismissed her concerns and appeared irritated by her questions, offering no substantial response. Despite this, Mofidi’s team continued to excel, earning two Webby Award nominations for their work on Apple Fitness+ audio projects like "Time to Walk" and "Time to Run."

Yet the praise didn’t shield her from the fallout. Following her involvement in the investigation into Blahnik’s conduct, Mofidi claims Blahnik exploded at her during a meeting, marking the beginning of a downward spiral in her treatment. In April 2023, she was given an ultimatum: either accept a performance improvement plan or sign a severance agreement.

Retaliation and a Hostile Work Environment

Mofidi alleged that her participation in the investigation led to retaliatory actions from Blahnik, who allegedly unleashed a “storm of disturbing hostility” after Mofidi reported her concerns to Apple’s employee relations team. Despite being praised by other employees for her work, the company refused to allow Mofidi to transfer to another department, such as Apple Podcasts or Apple TV+, as she had requested.

The escalating hostility prompted Mofidi to take medical leave in June 2023 to manage anxiety caused by her toxic work environment. In October, Apple concluded its investigation, finding no conclusive evidence of retaliation but inviting Mofidi to return to work. Mofidi, however, insisted that she would only return under different management, a request Apple rejected.

A Forced Resignation and Legal Action

Unable to secure a transfer to another department, Mofidi resigned from her position, citing the inability to work under Blahnik's management as the primary reason. She is now seeking compensatory damages, including lost wages and benefits, as well as punitive damages and attorney fees.

Her attorney, John-Paul S. Deol, emphasized that this lawsuit was not just about seeking justice for Mofidi, but also about holding corporations accountable for retaliation and inequality in the workplace. “This case highlights the urgent need for systemic changes to prevent powerful companies from punishing employees who stand up against injustice,” Deol said.

Apple and Blahnik have yet to comment on the lawsuit, and their legal representation has not been disclosed.

Mofidi, represented by Deol and Michael R. Fleming of the Dhillon Law Group Inc., remains determined to secure justice, not only for herself but also for others facing similar injustices in the workplace.
