A federal judge delivered a sharp rebuke to the Justice Department this week, denying their motion to dismiss a high-profile deportation lawsuit while questioning the government's handling of Abrego’s case.

U.S. District Judge Paula Xinis didn't mince words when addressing Justice Department attorney Bridget O'Hickey during proceedings involving Kilmar Abrego Garcia, a Salvadoran national whose deportation and subsequent return to the U.S. has sparked significant legal controversy.

"You made three arguments, defendants, and none are availing … meritless," Judge Xinis told O'Hickey, firmly rejecting the government's attempt to dismiss the case.

The legal drama began in mid-March when Abrego Garcia was deported from the United States to El Salvador and immediately detained in CECOT, the country's notorious maximum-security prison. As a validated MS-13 gang member, his removal was part of broader immigration enforcement efforts targeting gang affiliations.

However, the case took an unexpected turn when Judge Xinis ordered the government to facilitate Abrego Garcia's return to the U.S. The government initially claimed it lacked the power to bring him back, filing motions stating their inability to comply with the court's directive.

Less than a week later, the government transported Abrego Garcia back to the United States and immediately indicted him on human trafficking charges in Tennessee – all, according to Judge Xinis, without notifying the court or his attorneys.

"Obviously you did have power to produce Mr. Abrego because you produced him less than a week later," Judge Xinis pointedly observed, referencing the May 21 sealed indictment that came just six days after the government claimed powerlessness.

Judge Xinis expressed serious concerns about the Justice Department's handling of the case, particularly their failure to inform her court about ongoing plans to investigate and prosecute Abrego Garcia.

"I found it highly problematic that there had been a plan by the government to investigate Abrego Garcia and bring him back for prosecution without informing her court that it was doing so," Xinis stated during the proceedings.

The judge's frustration was palpable when she questioned whether the department's attorneys knew about the Tennessee indictment while arguing they couldn't return Abrego Garcia to the U.S.

"At some point, don't you have an obligation to me to say, 'Judge, we have the power, we produced him, moot,'" she asked O'Hickey.

The Human Trafficking Charges

Abrego Garcia now faces human trafficking charges in Tennessee stemming from a 2022 traffic stop. Court records indicate that his upcoming trial will likely expose additional evidence of domestic violence that endangered his wife and children's safety and welfare. His wife previously testified in requesting a restraining order against him, documentation that strengthens the government's case and justifies immediate removal upon conviction.

If convicted on the trafficking charges, subsequent removal proceedings could potentially render his civil and immigration lawsuits moot – a possibility that may influence the government's strategy moving forward.

Government's Shifting Explanations

Throughout the proceedings, the government's explanations for their actions have evolved. Attorney O'Hickey argued that the Justice Department had been in ongoing conversations with El Salvador to bring Abrego Garcia back while simultaneously filing motions to dismiss his lawsuit.

"How can this representation be one I can credit," Judge Xinis asked, highlighting the apparent contradiction in the government's position.

O'Hickey characterized the deportation as an "isolated error," stating, "We've acknowledged this was an error and have now acknowledged that error and have no intention of making that error a second time."

However, Judge Xinis remained skeptical, noting that "for three months your clients told the world they weren't going to do anything to bring him back." She specifically referenced public statements by the President, Homeland Security Secretary Kristi Noem, and Attorney General Pam Bondi suggesting no action would be taken.

Future Implications and Ongoing Uncertainty

The case remains far from resolved, with significant implications for both Abrego Garcia's fate and broader immigration enforcement practices. Justice Department attorney Jonathan Guynn indicated that if Abrego Garcia were released from pretrial detention in Tennessee, the Department of Homeland Security intends to remove him from the U.S., though they haven't decided whether to send him to a third country or challenge previous court orders barring his removal to El Salvador.

This uncertainty leaves open the possibility that Abrego Garcia could end up back in CECOT prison, depending on the government's final decision.

Judge Xinis has ordered additional testimony from government officials with "firsthand knowledge" who can testify about the government's plans for Abrego Garcia's removal if he's released from detention.

"It's like trying to nail Jello to a wall trying to find out what is going to happen next week [if he is released from detention]," Judge Xinis said.

Looking Ahead

While denying the government's motion to dismiss, Judge Xinis acknowledged that future developments could potentially make Abrego Garcia's lawsuits moot. However, she firmly stated, "I don't find at the moment that this case is moot."

The judge's remarks suggest she remains reasonably open-minded that circumstances could change, but for now, the case continues with heightened judicial scrutiny of government actions.
