Broadcom And Apple $1.1B verdict

In a legal twist that leaves onlookers in suspense, the California Institute of Technology and Broadcom jointly requested a California federal judge to dismiss the patent infringement litigation, which earlier witnessed a staggering $1.1 billion verdict. The move comes just two months after the two tech giants hinted at a potential settlement. While the request for dismissal offers no explicit details, it casts a veil of perplexity over the case's future.

Broadcom And Apple $1.1B Verdict :A Mysterious Move

The brief stipulation and request for dismissal were filed jointly on Wednesday, leaving observers to ponder the enigmatic turn of events. It refrains from shedding light on the circumstances and neither confirms nor denies a settlement. Requests for clarity from representatives of both Broadcom and Caltech went unanswered, deepening the mystery surrounding the case.

Caltech and Broadcom, in the stipulation presented to U.S. District Judge George H. Wu, expressed their intention to dismiss all of Caltech's claims and Broadcom's counterclaims, marking them with the weighty term "prejudice." Further adding to the intrigue, Caltech opted to abandon all claims against co-defendant Apple, urging the court to similarly dismiss Apple's counterclaims with the same weighty label.

It's worth noting that while Apple and Broadcom share a legal team led by WilmerHale, this filing was not made on behalf of Apple. Corporate representatives for Apple remained tight-lipped about this development.

According to the stipulation, each party will be responsible for its own legal fees and associated costs, creating an aura of unpredictability in the legal proceedings.

A Contentious History

This legal drama began with Caltech accusing the two tech giants of infringing three Wi-Fi chip patents crucial for devices like the iPhone. A California federal jury in January 2020 delivered a shocking verdict, finding Apple and Broadcom guilty of willful patent infringement, slapping them with the astronomical $1.1 billion penalty.

However, the Federal Circuit later vacated the damages award in February 2022, citing concerns with Caltech's damages theory. Apple and Broadcom weren't content with this development, asserting that the Federal Circuit overstepped its bounds by broadening the scope of arguments that could be raised by companies accused of infringement during inter partes reviews.

Apple and Broadcom made a plea for the Federal Circuit to reconsider its decision, and when that avenue was closed, they took their case to the U.S. Supreme Court. In June 2023, the highest court denied their petition, setting the stage for a return to the district court to revisit the contentious issue of damages.

Caltech, in a surprising turn of events in August, hinted at a "potential settlement," further adding layers of complexity to the ongoing legal saga.

Patents in Focus

The patents at the center of this high-stakes dispute are U.S. Patent Nos. 7,116,710 and 7,421,032.

Representing Apple and Broadcom in this legal battle are Richard L. Wynne Jr. and Robert K. Jain of Holland & Knight LLP, along with Mark D. Selwyn and James M. Dowd of WilmerHale.

Caltech's legal team is comprised of James R. Asperger, Kevin P.B. Johnson, Rachael L. McCracken, Ray Zado, and Todd M. Briggs of Quinn Emanuel Urquhart & Sullivan LLP.

This intricate legal web unfolds in the case of California Institute of Technology v. Broadcom Ltd. et al., case number 2:16-cv-03714, in the U.S. District Court for the Central District of California.

As this legal thriller unfolds, the verdict's fate remains tantalizingly uncertain, leaving all parties involved, as well as eager observers, on the edge of their seats.
