A 15-year-old student, who has concealed her identity using a pseudonym, has filed a groundbreaking $30 million federal lawsuit against Loudoun County Public Schools, accusing them of a grave breach of Title IX in the wake of her sexual assault by a male student in a school restroom on May 28, 2021.

The girl's father, Scott Smith, a plaintiff in the case and an outspoken advocate for justice, declared, "It's been a very long two and a half years for my family to get here. We have put together a very strong Title IX lawsuit that we hope sets precedence across the nation to protect children and hold school districts accountable."

The shocking incident set off a nationwide debate over policies permitting students to use restrooms of their chosen gender, with concerned parents raising the specter of sexual abuse. 

In this particular case, the perpetrator was quietly moved to another school with minimal discipline, only to assault another girl just months later. He has since been convicted for both assaults.

The lawsuit alleges a cover-up orchestrated by Loudoun County Public Schools, claiming that "political motives" led to a failure to address the assault adequately. 

Title IX case 

The Smiths, represented by Virginia Republican State Senator Bill Stanley, are seeking $30 million in damages, citing trauma and post-assault abuse from peers that affected the victim's access to an adequate education.

Notably, Scott Smith himself faced legal troubles after his arrest at an LCPS school board meeting while speaking out about his daughter's assault and accusing then-Superintendent Scott Ziegler of a cover-up.

 Although initially charged with obstruction of justice and disorderly conduct, he was recently pardoned by Governor Glenn Youngkin.

A subsequent grand jury report lent credibility to Smith's claims, indicting Ziegler and leading to his termination. 

Despite being informed of a Loudoun County Sheriff's Department investigation into the assault, Ziegler had publicly denied any reports of restroom assaults.

He was also found guilty of a misdemeanor for the improper termination of a teacher who had testified before the grand jury investigating him.

On September 30, 2021, two leaders in the National School Boards Association told the White House that disruptive parents should be treated as domestic terrorists. And they co-wrote a letter with Biden’s staff supposedly addressed to President Biden. 

The letter suggests that parents who object to mask mandates and the imposition of critical race theory (CRT) in classrooms are engaging in “a form of domestic terrorism.” 

The NSBA Board had disavowed the letter by October 22nd. 

But before the NSBA could walk back the letter on October 4, 2021, Attorney General Merrick Garland directed the FBI and NSA to get involved. 

He later admitted that he did not review the very thin cases that were used as evidence. One of the cases was Scott Smith’s arrest for confronting the Loudoun County School Board about his daughter’s assault and the cover-up.
