A dead man’s life insurance has become the center of a $30 million fight over one of the insurance industry’s most controversial practices — strangers investing in someone else’s death.

The estate of George A. Neukom Jr., who died September 5, 2023, has sued U.S. Bank National Association, Wilmington Trust National Association and two unidentified entities called Company A and Company B in federal court in Iowa.

The complaint, filed September 11, alleges Neukom’s life became the subject of two multimillion-dollar stranger-originated life insurance policies. The case is Neukom et al. v. U.S. Bank National Association et al., No. 4:26-cv-00382, in the U.S. District Court for the Southern District of Iowa.

According to the lawsuit, U.S. Bank owned and was beneficiary of a $20 million Principal Life Insurance policy issued on Neukom in 2008. After Neukom died, U.S. Bank allegedly collected the $20 million death benefit and transferred the proceeds to Company A.

Wilmington Trust allegedly owned and served as beneficiary of a separate $10 million policy and, after collecting that death benefit, transferred the money to Company B. The estate says it still does not know the identities of those two companies.

That detail matters.

Life insurance normally protects someone who would suffer financially or personally from another person's death — a spouse, family member, business partner or creditor, for example. STOLI arrangements can reverse that economic relationship. Instead of benefiting from the insured remaining alive, an investor can financially benefit when the insured dies.

That is where the centuries-old prohibition against wagering on human life enters the case.

Delaware law generally prohibits someone from procuring life insurance on another person unless the proceeds are payable to the insured, the insured’s representatives, or somebody possessing an insurable interest. For unrelated parties, that generally requires a lawful and substantial economic interest in the insured remaining alive — not an interest created or increased by the person's death.

The Neukom estate alleges a Wisconsin company called Oceanus procured the two policies as part of a much larger operation involving approximately 160 policies on senior citizens. The complaint asserts civil conspiracy, aiding and abetting and insurance-law violations. Those allegations have not been proven, and the defendants had not filed substantive responses when the litigation was reported.

The estate’s recovery theory has significant support in Delaware insurance law if it can prove the policies lacked insurable interest when created.

Under 18 Del. C. § 2704(b), when death benefits are paid under a policy obtained in violation of Delaware’s insurable-interest requirement, the insured’s executor or administrator may bring an action against the person who received those benefits.

The Delaware Supreme Court has repeatedly confronted STOLI litigation. In Wells Fargo Bank v. Estate of Malkin, the court explained that a policy lacking the required insurable interest can be void from its inception and that an estate may pursue death benefits already paid to the recipient.

There is an important limitation, however. In February 2026, Delaware’s high court held in GWG DLP Master Trust v. Estate of Frank that claims under § 2704(b) generally face a three-year statute of limitations, although traditional tolling doctrines may apply in cases involving concealment or fraud.

That makes these cases far more complicated than simply proving who received the money.

The Neukom litigation may ultimately force the court to reconstruct transactions dating back nearly two decades and determine who actually financed, controlled and economically benefited from the policies when they were created.

The uncomfortable question underneath the paperwork is remarkably simple: Was this legitimate life insurance — or was somebody placing a $30 million financial bet on when George Neukom
