Hatch Trick religious discrimination lawsuit

The Sunday Irony That Won't Go Away

The backdrop against which this lawsuit unfolds is impossible to separate from the story itself. Chick-fil-A is one of the most recognizable corporate practitioners of faith-based scheduling in American business — the chain closes all of its roughly 3,000 locations every Sunday without exception, a policy rooted in founder S. Truett Cathy's Christian beliefs. The company's website frames the Sunday closure as an opportunity for employees "to rest, enjoy time with their families and loved ones or worship if they choose."

That a Chick-fil-A franchisee now stands accused of firing an employee specifically because she sought to do exactly that — on her faith's designated holy day — is a contradiction that the EEOC's lawsuit makes no effort to soften.

Chick-fil-A Steps Back, Franchisee Steps Forward

Faced with the lawsuit, Chick-fil-A itself has moved to distance the corporate brand from the franchisee's employment decisions. The company declined to comment to the BBC but offered a carefully worded statement to Austin ABC affiliate KVUE: "It's important to know that, as a franchise business, all employment decisions are solely the responsibility of each individual restaurant owner."

The statement is legally accurate — franchisees operate as independent business owners and bear responsibility for their own HR decisions. But it does little to resolve the reputational dissonance of a brand synonymous with Sabbath observance now pointing its finger at a franchisee accused of punishing an employee for the same.

What the Law Requires

Under Title VII of the Civil Rights Act, employers are required to provide reasonable accommodations for employees' sincerely held religious beliefs, unless doing so would impose an undue hardship on the business. The threshold for what constitutes undue hardship has been interpreted broadly by courts in recent years, but the EEOC's position in this case is that having a driver cover a dispatch role one day per week, or adjusting a schedule to accommodate post-sundown Saturday availability, does not come close to meeting that threshold.

The lawsuit seeks relief for the terminated employee, including back pay, compensatory damages, and injunctive measures requiring Hatch Trick to implement policies preventing future religious discrimination.

For an employee who asked for one day off per week to honor her faith — and offered to find her own workarounds to make it work — the federal government has decided her case is worth fighting for.
