Fiat Chrysler Engineers RICO Suit

In a gripping development reminiscent of a high-stakes chess game, the Sixth Circuit Court made a decisive move in the ongoing legal saga surrounding a group of engineers against corporate giants. On Wednesday, the court upheld a prior decision, essentially slamming the brakes on the engineers' RICO suit against former United Auto Workers (UAW) leaders and Fiat Chrysler executives. The engineers accused these corporate titans of orchestrating a long-standing bribery plot that corroded the very fabric of their labor contract.

A trio of judges, unanimous in their decision, echoed U.S. District Judge Robert H. Cleland's finding. The lawsuit, brought forward by 47 engineers from Fiat Chrysler's elite Advance Manufacturing Engineering Powertrain division, was struck down as time-barred. These engineers, with their careers entwined in the labyrinth of auto engineering, charged forward with claims under both the Labor Management Relations Act and the Racketeer Influenced and Corrupt Organizations Act.

The Clock Strikes Against Justice

"Plaintiffs unearthed their grievances as early as 2011, stumbling upon the bribery web in July 2017, yet they stalled until October 2020 to raise their legal voice, leaving the delay unexplained," U.S. Circuit Judge Joan L. Larsen penned in the ruling. This hesitation, it seems, was the fatal flaw in their legal strategy.

The roots of this convoluted tale trace back to 2011, when Stellantis-owned FCA uprooted these engineers from their Auburn Hills base to Trenton, Michigan. The transfer, they claimed, was a breach of their collective bargaining agreement – denying them relocation allowances and more. This grievance, filed in 2015, was the first domino to fall.

A Tangled Web of Greed and Deception

The plot thickened in 2017 with the revelation of a grand bribery scandal. FCA executives, in a move straight out of a corporate thriller, were accused of funneling millions in illegal payments and extravagant gifts to top UAW officials. The aim? To tip the scales in their favor during collective bargaining. The UAW, in a controversial twist, withdrew the grievance, leaving the engineers in a legal limbo.

It wasn't until 2018 that the same grievance was refiled, and the UAW, after nearly two years, found merit in the engineers' claim, paving the way for the 2020 lawsuit.

The Legal Labyrinth: Navigating the Statute of Limitations

The panel, in their Wednesday revelation, highlighted a crucial point: the six-month window for the engineers' claims under the Labor Management Relations Act began ticking in 2015, with the filing of the initial grievance. The engineers, aware of the UAW's abandonment of their claim, unwittingly let the sands of time run out.

Furthermore, even the 2018 grievance, laced with details of the bribery scandal, was deemed a mere echo of past complaints. "These new allegations merely illuminated what was already known – the UAW's conflicting interests with the plaintiffs," Judge Larsen observed.

Equally, the four-year statute for the engineers' RICO claims offered no refuge. The panel underscored that the engineers were cognizant as early as 2011 or 2012 of FCA's alleged breach of the collective bargaining agreement, setting the statute's clock in motion.

"Equity favors the vigilant, not those who sleep on their rights," Judge Larsen remarked, underscoring the plaintiffs' failure to act promptly and the court's subsequent dismissal of any equitable tolling to rescue their RICO claims.

A Saga of Corruption and Consequence

This legal battle stems from a broader corruption investigation into FCA by the U.S. Attorney's Office for the Eastern District of Michigan. Accusations flew as company executives were charged with diverting funds meant for the UAW-Fiat Chrysler National Training Center to union officials, in exchange for bargaining concessions.

In a twist of corporate justice, FCA admitted guilt in 2021, agreeing to a $30 million fine for diverting $3.5 million to UAW officials from 2009 to 2016. The UAW, in a separate agreement, consented to pay the IRS $1.5 million and submitted to six years of monitoring.

This scandal has seen its share of fallouts, with key figures like FCA's former VP for Employee Relations, Alphons Iacobelli, receiving prison sentences for their role in the bribery scheme.

Legal Representatives: A Mosaic of Counsel

As the dust settles, the legal teams remain on standby. The engineers' battle is championed by Kenneth D. Myers, while FCA's defense is fortified by a team from Sullivan & Cromwell LLP and Miller Canfield Paddock & Stone PLC. UAW's legal strategy is helmed by representatives from Bredhoff & Kaiser PLLC. The case, while resolved in the courts, leaves a lingering question: in the grand theatre of corporate America, is justice a matter of timing or truth?
