Candace Owens has released what she says is an exclusive audio interview with the only witness known to have recorded video of a person on the roof of Utah Valley University's Losee Center shortly before Charlie Kirk was fatally shot.

In a post on X, Owens claimed that despite recording what could be an important piece of evidence, the witness has never been contacted by prosecutors, the defense, or federal investigators.

"Today we have an Exclusive Recording of the LONE person to have recorded the alleged shooter dropping onto Losee Rooftop. Remarkably, the prosecution, defense, and Feds have not followed up with him," Owens wrote.

In the recording, the witness explains that he noticed someone dressed entirely in black standing on the roof during the event. He says the person appeared to be wearing tactical clothing, along with what looked like a helmet and face covering.

Because the scene struck him as unusual, he pulled out his phone and started recording.

According to the witness, he stopped filming after a few seconds. Roughly five seconds later, he heard what he believed was the gunshot.

He says the person then ran across the roof using what he described as tactical movements before disappearing. He also recalls the firearm looking smaller than a traditional sniper rifle, comparing it to what he believed was a .223-style rifle.

The account has drawn attention because some of the details appear to differ from the timeline prosecutors presented during the preliminary hearing. Prosecutors have argued that the accused shooter was wearing jeans and arrived on the Losee Center roof around 12:15 p.m. after dropping onto it.

At this point, it's not clear whether the person described by the witness is the same individual prosecutors believe carried out the shooting or someone else entirely. The witness's account has not been presented in court or tested through cross-examination.

The recording also brings renewed attention to several pieces of physical evidence that have become a focus during the hearings, including a backpack, jacket, and gloves that investigators recovered near Fulton Library along what prosecutors say was the suspect's escape route.

What Happened During the Latest Hearing?

The five-day preliminary hearing wrapped up on July 10, with prosecutors presenting the evidence they believe is sufficient to move the case to trial. Because it was a preliminary hearing, the judge was not deciding guilt or innocence but whether there was probable cause to proceed. A ruling is expected after written arguments are submitted in September.

Over the course of the hearing, prosecutors presented surveillance footage, forensic evidence, DNA analysis, witness testimony, and digital evidence that they say ties Tyler Robinson to the shooting. Investigators testified about video they say tracks Robinson's movements on and around the Utah Valley University campus before and after the shooting, while forensic experts discussed DNA recovered from evidence that prosecutors allege is connected to the crime. The court also heard testimony from Robinson's former roommate, who told investigators that Robinson later expressed regret and indicated he wanted to turn himself in.

The defense challenged several parts of the prosecution's case rather than presenting its own version of events. Defense attorneys questioned the reliability of the DNA evidence, cross-examined forensic experts, and argued that investigators may not have fully explored other possible leads or alternative suspects. They also raised questions about certain pieces of physical evidence recovered along the alleged escape route, including a backpack, jacket, and gloves, arguing that additional testing or investigation could have been helpful.

The hearing also included disputes over what evidence could be shown publicly. While some surveillance footage was displayed in open court, other exhibits were viewed only by the judge or shown under restrictions intended to protect the defendant's right to a fair trial.

Judge Tony Graf will ultimately decide whether prosecutors have presented enough evidence to bind the case over for trial. That decision has not yet been made.

Why Are Some People Questioning the Prosecution's Case?

The audio released by Candace Owens has sparked discussion because the witness's account differs in some respects from evidence presented during the preliminary hearing.

In the recording, the witness describes seeing a person dressed in black tactical-style clothing on the roof of the Losee Center shortly before the shooting. During the hearing, prosecutors presented surveillance footage, DNA evidence, witness testimony, and digital evidence that they argue identifies Tyler Robinson as the shooter and traces his movements before and after the attack.

The defense has also challenged parts of the state's case. During the five-day hearing, Robinson's attorneys questioned the reliability of the DNA analysis, argued that investigators did not adequately pursue alternative leads, and raised concerns about aspects of the forensic investigation. They also disputed portions of the prosecution's timeline and the interpretation of some of the evidence.

Supporters of the prosecution argue that the state's case is based on multiple forms of evidence rather than any single witness. Prosecutors presented surveillance footage they say tracks Robinson's movements, forensic testimony linking DNA to evidence recovered during the investigation, and testimony from Robinson's former roommate, who told investigators Robinson expressed regret after the shooting.

Meanwhile, those who remain skeptical argue that unanswered questions raised by the defense, along with Owens' newly released witness interview, deserve further examination. The witness's account has not been introduced as evidence in court, has not been tested through cross-examination, and investigators have not publicly responded to Owens' claim that the witness was never contacted.

The judge has not yet ruled on whether the case will proceed to trial. Written arguments from both sides are scheduled to be submitted before the court decides whether prosecutors have established probable cause to move the case forward.
